<p>Many thanks for your question.</p>
<p>You will need to look at the terms of their tenancy agreement. Most contracts allow immediate family members to stay in the property. However,  if you were very specific in the terms about the number of people allowed live in the flat then having their sister living there is breach of the terms of that agreement.</p>
<p>On the other hand, if the relative is only visiting they are allowed to have her there as it is only a temporary, and you can not stop one’s relative from visiting. Unless specifically stated in the contract, no you can not increase the rent for those 2 months.</p>
<p>I would advise the best way forward would be to speak to the tenants and try to reach an agreement where they could perhaps increase their contribution to the utility bills for the 2 months period their guest is there.</p>
<p>Does your contract have a break clause in it? If so, then you can activate this if you find that after 2months the relative is still there and the tenant will not consent to a rent increase.</p>

<p>As soon a Tenant is 2 months in arrears i.e. one month and one day, a Section 8 Notice can be served to the Tenant. Any Solicitor will be able to serve the notice for you once they have been provided with the relevant information.  The Tenant will then have 14 days to clear all or some of the arrears.  Once the Notice has expired and If the Tenant has not vacated or cleared all or some of the arrears then it will be necessary to start court possession proceedings.</p>

After this time, the Landlord and Tenant are encourage to resolve any disagreements. If the Landlord and Tenant are unable to come to an agreement then either party may refer the matter of the dispute to the Independent Case Examiner appointed by the Scheme Managers in order for them to make a decision based on the evidence supplied. Any disputes should be raised within 6 months of the Tenancy end date.</p>

So an accurate detailed and independent inventory is an essential safeguard against costly disputes and loss of money both for the landlord and/or their agent and the tenant.</p>
