My tenant moved her sister in with her for two months - can i increase the rent?


Landlord:

My tenant and her partner have moved her sister in with them for two months,in a one bedroom flat, i pay all the bills they pay me a monthly sum she did not tell me she had done this can i increase the rent for the two months?

Many thanks for your question.

You will need to look at the terms of their tenancy agreement. Most contracts allow immediate family members to stay in the property. However, if you were very specific in the terms about the number of people allowed live in the flat then having their sister living there is breach of the terms of that agreement.

On the other hand, if the relative is only visiting they are allowed to have her there as it is only a temporary, and you can not stop one’s relative from visiting. Unless specifically stated in the contract, no you can not increase the rent for those 2 months.

I would advise the best way forward would be to speak to the tenants and try to reach an agreement where they could perhaps increase their contribution to the utility bills for the 2 months period their guest is there.

Does your contract have a break clause in it? If so, then you can activate this if you find that after 2months the relative is still there and the tenant will not consent to a rent increase.
